What a non-compete in North Carolina can and cannot do in 2026
North Carolina courts enforce a non-compete only when it is in writing, signed at the start of employment or for new consideration, and no wider than the employer’s legitimate interest in time, territory and scope. A clause that fails any one of these fails in full; the courts here do not rewrite it into something narrower.
In practice that means six to twelve months in the counties where the employee actually worked is the range we see upheld. Two years across the state for a regional manager was struck down in a ruling we obtained this spring.
